These Terms of Service (“Terms”) govern your access to and use of the HomeScope website, web application, and related services (collectively, the “Services”) operated by Sandingzone, Inc., a Delaware corporation (“Sandingzone,” “we,” “us,” or “our”). HomeScope is a software product that converts home-inspection photographs into structured defect reports using artificial intelligence. By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Acceptance and Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. If you use the Services on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms, and “you” refers to both you individually and that entity.

2. Description of Services

HomeScope allows users to upload photographs from a property walkthrough and receive AI-assisted analyses that identify potential defects, organize them by room, assign severity levels, and produce a shareable inspection report in PDF and web formats. The Services are intended as a professional productivity tool for licensed home inspectors and informed homeowners. The Services do not replace professional inspection, structural engineering, or legal advice.

3. Account Registration and Security

To use the Services, you must create an account through our authentication provider. You agree to:

• Provide accurate and current registration information
• Keep your credentials confidential
• Be responsible for all activity that occurs under your account
• Notify us promptly at admin@sandingzone.com of any unauthorized access

We may suspend or terminate accounts that we reasonably believe are compromised, fraudulent, or used in violation of these Terms.

4. Your Content and License

You retain ownership of the photographs, text, and other content you upload to the Services (“Your Content”). You grant Sandingzone a worldwide, non-exclusive, royalty-free license to host, transmit, process, display, and otherwise use Your Content solely to operate and provide the Services to you, including transmission to third-party processors described in our Privacy Policy. You represent and warrant that:

• You have all rights necessary to upload Your Content and to grant the license above
• Your Content does not infringe any third party's intellectual property, privacy, or other rights
• You have obtained any necessary consents before photographing property that belongs to others, and you will not upload content that identifies individuals without their consent where required by law

5. Acceptable Use

You agree not to:

• Upload malware, infringing content, sexually explicit material, or content depicting individuals without lawful basis
• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to reverse engineer, decompile, or otherwise derive the source code or underlying AI models of the Services
• Circumvent, disable, or interfere with security, authentication, rate-limiting, or access-control features
• Resell, sublicense, or commercially exploit the Services in a manner not expressly permitted by these Terms
• Use automated means (bots, scrapers) to access the Services in a way that imposes an unreasonable load

6. AI Output and Inspector Responsibility

HomeScope provides AI-generated drafts to assist a licensed home inspector in producing a final inspection report. AI output is a draft. The licensed home inspector using the Services is solely responsible for reviewing, verifying, editing, and approving every finding before it is delivered to a client. The inspector must independently confirm that the final report complies with the applicable state Standards of Practice (“SoP”), state licensing requirements, and any governing professional body rules.

AI output is inherently probabilistic and may contain errors, omissions, or misclassifications. The Services are not a substitute for on-site professional inspection, structural engineering, or legal advice. You agree not to rely on AI output as the sole basis for structural, safety, legal, or financial decisions, and you agree to clearly communicate to your clients that the final report represents your professional judgment and not the output of an automated tool.

6A. Zero Third-Party Monetization Commitment

Sandingzone contractually commits that HomeScope does not sell, rent, or share your client contact information with third parties, and will not embed third-party marketing, contractor referral widgets, or advertising into your client-facing portal or reports. This is a permanent commitment incorporated into these Terms and restated on our public Promise page. Sandingzone's revenue is derived exclusively from subscription fees paid by its users. If this commitment is ever materially changed, Sandingzone will (a) post revised Terms with an updated “Last updated” date, (b) notify active users by email at least 30 days before the change takes effect, and (c) provide a no-cost mechanism to export your account data before the revised terms apply to you.

7. Fees

Some features of the Services may be offered free of charge during early availability. Paid plans, usage-based pricing, and their cancellation terms will be described at the time they are offered. By subscribing to a paid plan, you authorize us to charge the payment method you provide for the amounts specified at checkout. Fees are non-refundable except where required by law.

8. Intellectual Property

Sandingzone and its licensors retain all right, title, and interest in and to the Services, including all software, interfaces, visual design, documentation, and trademarks. Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Services will be uninterrupted, error-free, or that AI output will be accurate, complete, or suitable for any particular purpose.

10. Limitation of Liability

HomeScope provides AI-generated draft tools. Final inspection responsibility lies solely with the licensed inspector. To the maximum extent permitted by law, Sandingzone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Sandingzone's total aggregate liability for any claim arising out of or related to these Terms or the Services shall not exceed the greater of (a) the total subscription fees you paid to Sandingzone for the Services in the trailing 12 months preceding the event giving rise to the liability, or (b) one hundred US dollars (US $100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Sandingzone, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) any inspection report you generate, publish, share, or deliver using the Services, (c) your use of the Services in violation of these Terms or applicable law, or (d) your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there. You and Sandingzone each waive any right to a jury trial and to participate in a class action to the extent permitted by applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Services. Sections 4 (Your Content and License) with respect to content already processed, 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), 12 (Governing Law), and 14 (Miscellaneous) survive termination.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above and, where appropriate, by providing additional notice. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sandingzone regarding the Services and supersede any prior agreements. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign them without restriction.
